This action of trespass on the case was brought in the circuit court of Wise county by the administrator of Guy James, deceased, to recover damages for the death of his intestate, which is alleged to have been caused by the negligence of the Black-wood Coal and Coke Company. The trial in the circuit court resulted in a verdict and judgment in favor of the plaintiff, ■which we are asked to reverse and set aside.
