It is not possible to feel anything less than the deepest compassion for the young plaintiff who incurred serious and apparently permanent injuries as a result of the tragic accident of April 29, 1984, an accident in which another Norwich University student lost his life.
Sympathy in the face of such devastating tragedy is a natural, human and humane response. I am sure it is felt by each member of this Court regardless of whether he joins with the unfortunate majority opinion or writes separately in dissent. Nevertheless, expressed in its simplest elemental form, the majority opinion is bad…
