This suit was brought by Elmer E. Curts, appellee here, against Otto Theis, appellant.
The plaintiff alleged that he was a broker for the purpose of negotiating and procuring mineral leases and contracts relating to lands in the state of Texas and elsewhere; “that appellant owned a three-fourths interest in 45,000 acres of land, comprising the Hayhook Ranch, in Hutchinson and Roberts Counties, Texas, appellant’s father, George Theis, Jr., then living, but now deceased, owning the other one-fourth interest, the two being tenants in common; that the said father, George Theis, Jr., was duly and…
