E. J. líale brought an equitable petition against Mrs. S. L. Owensby, praying for an accounting and other relief. Upon the coming in of the answer the attorneys for the parties entered into a written agreement stipulating for a reference of the case to the auditor; and it was acordingly referred. 'In the order of reference it was directed that the report should be filed in the clerk’s office of the superior court on or before the first Monday in September, 190.6.
