The plaintiff in error, hereinafter called defendant, wag convicted in the district court of Canadian county on a charge of subornation of perjury and was sentenced to serve a term of five years in the state penitentiary.
The record discloses that prior to February, 1925, Ernest Thomas, the defendant, and others, were charged in the county court of Canadian county with having the unlawful possession of intoxicating liquor.
