The plaintiff in error, for convenience hereinafter referred to as the defendant, was by information charged with the crime of murder; tried and convicted of manslaughter in the first degree, and sentenced to imprisonment in the state penitentiary for a term of four years.

Lucy Buck, a witness for the state, testified in substance as follows:
