This is an appeal from a decree of the District Court of the United States for the District of Columbia dismissing the petition of the United States Borax Company, relator-appellant', hereafter referred to as appellant, for a writ of mandamus directing the appellee, Harold L. Iclces, Secretary of the Interior, to cause to be issued and delivered to the appellant a patent of the United States for 80 acres of land in California.
