Smith, J.:
The plaintiff brings this action at law upon certain stock transactions had between the plaintiff and the defendant which is a stock brokerage partnership. Upon October 4, 1920, the plaintiff had with the defendant the following securities: 155 Sinclair Oil; 100 Endicott-Johnson; 100 American International Corporation; 50 Libby, McNeill & Libby. At the high point on that day the value of this stock was $19,742.50. At the lowest quotation upon that day the value of the stock was $19,121.25.
