Appeal from a judgment of the Supreme Court at Special Term (Shea, J.), entered May 23, 1985 in Clinton County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent Commissioner of Correctional *876Services finding petitioner guilty of violating a prison disciplinary rule.

Petitioner, an inmate at Clinton Correctional Facility, was charged with violation of disciplinary rule 108.13 which states, "Inmates shall not be in possession of any article or paraphernalia which by its unusual nature gives reasonable grounds…
