This action was brought by the state bank examiner to recover upon the superadded lia*256bility of a stockholder in. an insolvent state banking corporation. The trial resulted in a judgment in favor of the plaintiff. From this, the defendant appeals.
The facts necessary to present the legal question involved may be briefly stated.
