The late Chief Justice Hart would frequently say, in consultation, when the others were about to invade the province of the legislature : “Boys, if you are going to make a statute, make a darn good one.” In my opinion the majority in this case have amended the statute so as to make it meaningless, and,'instead of making a good one, have emasculated and destroyed whatever good there was in it.
