This action, brought in the Spartan-burg Division of the Western District of South Carolina, is now before me on a motion on the part of defendant to transfer to the Florence Division of the Eastern District.

The allegations of the complaint are that plaintiff, the owner of peach orchards in South Carolina, desiring to control a buildup of scale in its orchards, purchased from defendant, a manufacturer of fungicides, etc., sufficient dormant oil spray properly to treat these orchards; that plaintiff applied this spray to its orchards, and that thereafter many of plaintiff’s…
