Maria Da Gloria Vieira, Administratrix for the Estate of Carlos A. Vieira, deceased, challenges the denial of her claim for workers’ compensation death benefits filed pursuant to the provisions of the D.C. Workers’ Compensation Act of 1979, D.C.Code §§ 36-301 et seq., (1997 Repl.) which the Department of Employment Services (DOES) denied on the ground that the decedent’s death did not arise out of his employment.
