The Commissioner of Motor Vehicles of the State of New York appeals from an order of the Supreme Court at Special Term which directed summary judgment declaring invalid his promulgated regulation which required an applicant for a driving instructor’s certificate or a renewal thereof successfully to complete a 30-hour course in driver training and traffic safety at an accredited college or university as a condition precedent to licensure.
