The litigation over the matters set up in the pleadings has been long drawn out, and the record has become voluminous, but the questions presented for decision by the appeal are not many, and, in order to determine them, it will be necessary to consider only such portions of the record and evidence as are pertinent to the issues involved in the appeal.
