This is an appeal from a decree enjoining the use of Luckiamute Biver, a stream flowing through the counties of Benton and Polk, by defendant, under an alleged franchise acquired by it in pursuance of the provisions of an act of the legislative *395assembly approved February 27, 1901 (Laws 1901, p. 266; B. & C. Comp. § 4890, et seq.) Tbe only question for our consideration is the constitutionality of the act.
