Harvey, J.;

This is a suit to set aside a will. There was a trial to the court with the aid of a jury, which made special findings of fact and returned a general verdict for plaintiff. The court approved the findings of fact and rendered judgment for plaintiff. Thereafter the defendants filed a motion asking the court to set aside the answers to the special questions as returned by the jury and to make answers in opposition thereto, and also filed a motion for judgment, notwithstanding the general verdict.
