This is an action for compensation for the vaccine-related injury and death of Thomas Edmund Matthews (hereinafter Thomas) brought on September 22,1988 by his father, Donald J. Matthews, Sr., (hereinafter petitioner) as legal representative of Thomas, under the National Childhood Injury Program, 42 U.S.C.A. § 300aa-10 et seq. (West Supp.1989) (hereinafter Act or Vaccine Act).
