The facts in this case are the same as those in the case of Croft vs. Bunster and others, already decided, except as below stated. The note and mortgage in this case were dated, executed and delivered by Bun-ster to one James W. Story, on the the 23d day of May, 185'4. *514The mortgage was recorded on the 3d day of June following. The note was for $ 1,000, and payable to Story, or bearer, one year from date, with interest at 12 per cent. Story paid to one Macloon, who was. Bunster’s agent for that purpose, $1,000 as the consideration for the same, which sum Macloon paid…
