Josephine Lochridge as administratrix of the estate of her deceased husband, John Lochridge, instituted an action against the Western and Atlantic Bailroad for the homicide of her intestate. The petition was in two counts, one under the State law and the other under the Federal employer’s liability act. The first count was abandoned, and the ease was tried under the second *209count.
