NOURSE, P. J.-

This is an appeal from an order granting defendants’ motion for nonsuit in a personal injury action.

The evidence showed that in January, 1937, the Cleveland Wrecking Company made arrangements with defendant company whereby the latter would repair its truck tires and rims and would replace defective parts with new ones; subsequently all flat or damaged tires or rims were sent to defendant for repairs.
