OPINION

JORDAN, Justice.

This is an appeal from the trial court’s withdrawal of a case from the jury and the rendition of judgment in favor of appellee insurance company in a suit filed by appellants on a contract of insurance which in sured a house in Dallas sold by appellants to Clydell and Hattie Robertson. The policy was issued to the Robertsons as mortgagors of the house, with appellee named in the loss payable clause as the mortgagee.

We affirm.

Appellants purchased the house in question on May 3, 1976, for $3,650.00 and one week later sold it to Clydell and Hattie Robertson for $6,750.00.…
