‘The indictment was in four counts, each charging the appellant and J.ohn Cline with murder in the first degree, by administering poison to one Franklin P. Smith. He was found guilty, as charged in the second count of the indictment, and his punishment assesed at imprisonment for life, and, over a motion for a new trial, judgment was rendered upon the verdict.
*649The errors assigned, call in question the action of the court in overruling appellant’s motion to quash the second count of the indictment, and appellant’s motion for a new trial.
