Appeal is taken by the defendant -from a judgment of resentence imposed by the County Court, Tompkins County, on January 3, 1967, and from the denial of his motion made prior to the imposition of such resentence to withdraw his prior plea of guilty.

In the month of February, 1966, the defendant was indicted by the Grand Jury, Tompkins County, upon a charge of grand larceny in the first degree.
