—Judgment unanimously affirmed. Memorandum: Defendant appeals from a judgment of conviction of one count each of rape in the first degree, sodomy in the first degree and burglary in the first degree after a retrial necessitated by our reversal of his previous conviction of those crimes (People v Meurer, 184 AD2d 1067, lv denied 80 NY2d 907).
