JACKSON, Justice.

In the trial court, Alpha Finance Company filed a petition asking for the foreclosure of a $74,000 note and mortgage against substantial oil and gas leaseholds -owned by a defendant Great Western Oil and Gas Company. Shortly after suit was filed, and before any defendant had ■answered, R. J. Roberts was substituted as party plaintiff upon motion by Alpha, which motion was heard and sustained without notice to defendants.
