Since the trial of this case the plaintiff, R. J. Jenkins, has died and said'cause revived in Mayme L. Jenkins, Executrix of his estate. The Parties will be referred to as they appeared in the trial court.

Plaintiffs, real estate brokers in the City of Durant, Oklahoma, instituted this action in the District Court of Bryan County, the purpose of which was to recover a commission under an alleged oral contract with defendant for the sale of certain real estate situated in Atoka County.
