OPINION
STOREY, Judge.
This is an action for damages resulting from defendant attorney’s alleged malpractice in failing to perfect an appeal from a decision of the Industrial Accident Board denying plaintiff’s petition for review of compensation. Plaintiff was injured in an industrial accident in May of 1957 and received the last of his weekly compensation benefits on July 28, 1957. On December 31, 1957, plaintiff was treated by a doctor whose bill was paid by plaintiff’s employer’s compensation carrier in January of 1958.
