BOWMAN, Circuit Judge.

In this case Rosena Poston appeals from a conviction of misapplying federally insured funds in violation of 18 U.S.C. § 657. Lizzie and Bernard Poston appeal from convictions of aiding and abetting Rosena’s misapplication of federally insured funds in violation of 18 U.S.C. § 2(b) and 18 U.S.C. § 657.

In arguing for reversal, appellants assert that joint representation of the three defendants by a single attorney denied them the effective assistance of counsel guaranteed by the Fifth and Sixth Amendments. They also assert that this right was not effectively waived since…
