An action was commenced by plaintiffs in the circuit court of Marshall County to foreclose a trust deed, which contained the usual provision for attorney’s fees. Their attorney was Albert Pucci, county judge of Putnam County. The defendants amended their answer alleging the disqualification of plaintiffs’ attorney on the ground that his acting as attorney while holding the judicial office was contrary to public policy.
