Order, Supreme Court, New York County (Donna M. Mills, J.), entered March 14, 2008, which granted defendant’s motion for summary judgment dismissing the complaint, unanimously reversed, on the law, without costs, and the complaint reinstated.

Plaintiff was injured when the bus he was riding as a standee stopped suddenly, causing him to lose his footing. “To establish a prima facie case of negligence against a common carrier for injuries sustained by a passenger when the vehicle comes to a halt, the plaintiff must establish that the stop caused a jerk or lurch that was ‘unusual and violent’ ”…
