of the Commission of Appeals delivered the opinion for the court.

There is pending in the District Court of Hardin County (75th district) a certain suit in trespass to try title, styled Marrs McLean et al. v. Houston Oil Company of Texas et al., which will hereinafter be called the McLean case or the McLean suit. The defendants in that suit, the relators here, have petitioned this court for the writ of prohibition to stop further proceeding in said suit. The respondents herein include Honorable Geo. C.
