Error to Kent; Adsit, J. Trover by George M. Edison against Joseph Babka and Delia Babka. From a judgment for defendants on verdict directed by the court, plaintiff brings error.

This action was brought by the plaintiff as the assignee of a certain contract, which reads as follows:

“Memorandum of agreement made and entered into this 6th day of November, A. D. 1889, by and between Mrs. Dolly Orcutt and Joseph Babka and Delia Babka, his wife, of the township of Plainfield, county of Kent, *236and State of Michigan, parties of the first part, and Chas. E. Knapp, of the township of Grand Rapids, county of Kent, and State of Michigan, party of the second part, witnesseth:
