Suit by Gladys Pinkard, by her mother as next friend, against- appellants, seven in number, for the partition of a tract of 126 acres of land, alleging that she and appellants were the sole joint owners of said land. Appellants answered by general denial, plea of not guilty, and specially denied that appellee was a child of Lee Pinkard, deceased, through whom, as children, all parties claimed, and hence that she was not entitled to any portion of the land.

The ease was tried before the court without a jury, and judgment rendered finding that appellee and appellants were the sole joint owners…
