The history of this case will be found in. the report of the case of Gaines v. Relf and Chew, in 2 Howard, 619.
This is the fourth time that the cause has been before this court. Its' decision', in each instance hitherto, has been in favor of the complainants.. The third time, it was brought here upon points upon which the judges in the Circuit Court were divided in their opinions. They arose upon the argument of demurrers, filed by several of the defendants.
