I. Background

This case concerns alleged acts of retaliation against Plaintiff Paul Wesolowski (hereinafter “Plaintiff’) and his wife, Plaintiff Laura Wesolowski for a report made by Plaintiff in October 2004, in violation of rights protected by the First Amendment. Amended Complaint (Dkt. No. 9). At that time, Plaintiff was a corrections officer at the Ulster County Jail, with the rank of Corporal. Id. at ¶¶ 7-8.
