MEMORANDUM OPINION

STAGG, Chief Judge

I. INTRODUCTION:

This action was instituted by Jessie Lee Smith with allegations that his constitution al rights were violated, and that he was entitled to compensatory and punitive damages, and attorney’s fees under the provisions of 42 U.S.C. §§ 1983 and 1988. Smith also alleged that he was entitled to relief under Louisiana tort law. A three-day bench trial was conducted on June 13-15, 1984, during which extensive testimony was adduced from the defendant deputies, the plaintiff, jail inmates and expert witnesses.
