delivered the opinion .of the court:

This is an appeal from a decision of the Board of Appeals of the United States Patent Office affirming- the decision of the examiner denying patentability, in view of prior art, of all the claims' of an application for patent entitled “ Process for the Manufacture of Crotonie Aldehyde and Its Homologues.”

• Nine claims, numbered 1, 3, 4, 5, 6, 7, 8, 9 and 10, were covered by the appeal, but at the hearing before us the appeal as to claims Nos. 8 and 9 was withdrawn.
