ON DEFENDANT’S MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM UPON WHICH RELIEF CAN BE GRANTED.

Defendant Simister, doing business as Sonny’s Tire & Recapping, is a manufacturer of recapped tires. Defendant Stevenson operates a service station which performs mechanical repairs to automobiles and sells gas (when available), oil, and TBA 1 products.
