OPINION OF THE COURT

The State Commission on Judicial Conduct has determined that petitioner, a Justice of the Cold Spring Village Court, Putnam County, should be removed from office. Upon review of the record, this court agrees that this sanction is appropriate.

The credible evidence indicates that petitioner received a general power of attorney from his client, Fred H. Dunseith, in January, 1975. Petitioner used this to transfer assets totaling in value $135,000 from Dunseith to himself without informing Dunseith of many of the transactions during the period from 1975 to 1977.
