delivered the opinion of the court.

■ During the trial of the case in the Circuit Court the judge who had presided from the beginning was called to the death-bed of a brother, and another judge of the same circuit presided to the close of the trial and until final judgment upon the verdict of the jury, which was against appellants, for $533.20 as damages in an action of assumpsit.
