—Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered February 22, 1996, convicting defendant upon his plea of guilty of the crime of assault in the first degree.

Pursuant to a plea bargain agreement, defendant pleaded guilty to one count of the crime of assault in the first degree, waiving his right to appeal. Defendant has nonetheless appealed contending that his sentence of 4 to 12 years’ imprisonment was harsh and excessive.
