ORDER

CARR, District Judge.

This is a civil rights case brought under 42 U.S.C. § 1983 and related state claims. Pending is defendants’ motion for summary judgment (Doc. 20) and plaintiffs motion for partial summary judgment. (Doc. 19). For the reasons that follow, defendant’s motion shall be granted in part and denied in part and plaintiffs motion shall be denied.
