OPINION
WEISBERGER, Chief Justice.
This ease comes before the court on the defendant’s appeal from a judgment of conviction of first-degree murder entered in the Superior Court after a jury trial. Subsequent to the jury’s rendition of its verdict finding the defendant guilty of murder in the first degree, the trial justice granted the defendant’s motion for new trial. The state petitioned for review of the trial justice’s decision by writ of certiorari. This court issued the writ, and in State v.
