Jere Brookshire filed a petition seeking an implied easement across land owned by James Wright, Jr. to provide Brookshire access to a landlocked property that he owned, and, in the alternative, the condemnation of a private way of necessity across such land. Brook-shire moved for partial summary judgment as to his private way claim. The trial court granted such motion, and sub silentio denied Wright’s request to enjoin the condemnation.
