As heretofore stated, the questions involved were raised on demurrer to the defendant’s answer filed in the Court of Appeals, and the material facts are not in dispute. The plaintiff was the owner of two certain certificates of deposit, secured from The Security-Home Trust Company. On or about June 16, 1931, the plaintiff presented each of these certificates of deposit to The Security-Home Trust Company, which cancelled them and marked them paid, and thereupon issued to the plaintiff two drafts upon two different Cleveland banks.
