Appeal by the plaintiff, John 0. Sheehan, from an order of the Supreme Court, made at the New York Special Term and- entered in the-office of the clerk of the county of New York on - the 14th day of Atigust,. 1896, denying his motion to vacate an order for the examination of defendants’ witnesses before the trial of the action.

' The action was brought to recover damages for an alleged libelous publication in the New York World. The answer alleged that the publications were true. The action was commenced in 1894. The order for the examination of the witnesses was granted ex parte, and was made June 30, 1896. The-plaintiff made a motion at Special Term to vacate the order for the examination, on the ground of the insufficiency of the papers upon which it was granted, and upon the hearing of that motion, " July 16, 1896, an order was made denying the motion, and directing the examination of the witnesses to proceed…
