This is an application for a writ of habeas corpus, arising upon the petition of one Osald Manldchi, a Japanese.

The evidence, oral and documentary, shows that on the 4th day of May, 1899, a presentment was filed against the petitioner by the then Circuit Judge of the First Circuit of the Tenitory of Hawaii, and without the intervention of a grand jury, charging him with the crime of murder1; that afterwards, in the May term of that court, of the samei year, he was tried on the said presentment and convicted of the crime of manslaughter in the first degree.
