The plaintiff in error ’ commenced this action in the district court of Beaver county against the defendants in error, seeking the specific performance- of a contract relating to certain real estate.

The evidence produced by the plaintiff at the trial shows the following state of facts: Stephen R. Childress was the owner of the land in controversy; he died, leaving, surviving him, his widow, Margaret A. Chil-dress, and Walter M. Childress, Austin M. Childress, Henry H.
