The appellee, Lawrence F. Speckman, in returning in Ms automobile on the Shelbyville pike from Simpson-ville, Shelby county, to Louisville, the city of his residence, Sunday evening, October 4, 1914, upon reaching a point where the appellant Louisville & Interurban Railroad Company’s railroad track crosses the Shelbyville pike, sustained injuries to his person and automobile by the- falling of the latter into a ditch five or six feet below the edge of the turnpike.
